People mod there systems in order to play pirated software which is obviously illegal but others want to mod for personal reasons like playing Ripped Backups of Xbox 360 Games. There is two kinds of modding: External Modding and Internal or software modding. External modding is when you alter the casing or look of your Xbox 360. This type of modding is legal in most situations. The modding that is more questionable is internal modding or modding the software running on the Xbox 360. It would seem that if it’s your property you have the right to do what you want to your console, counter-intuitively this is not the case. Due to DRM protection (Digital Rights Management) modding your system violates the Digital Millennium Copyright Act of 1998. Therefore internal modding your system IS ILLEGAL.

If modding your Xbox 360 console is illegal then why do so many people do it? Since it has become illegal more people are jumping on the mod wagon. This is due to, just like other outlawed activities such as pirating movies and music, there is no enforcement as far as the law is concerned. There is of course exceptions; it is also illegal to performs these acts of modding for money. And there has been cases where people have been fined and arrested for having a system modding business. On the whole it is unclear what the penalty or punishment is for having a modded system.

After everything’s said and done people will continue to mod there Xbox 360 and other systems. It’s so easy to find resources on how to do it, and there are several reasons why modding a system benefits gamers. Some may be detoured by the legalities but ultimately it’s up to the gamer.
